What is Employment Discrimination?

April 30, 2021 by McPhillips, Fitzgerald & Cullum, LLP

Most of us are at least familiar with the idea of employment discrimination, but what is it actually and do you have a case? The only way to know for sure is to consult our experienced attorneys.

The attorneys at McPhillips, Fitzgerald & Cullum know both sides of these disputes. We defend employers and businesses, as well as handling the claims of individual employees. Because of this experience, we have extensive knowledge of the ins and outs of these claims, and thoroughly understand the relevant laws, such as:

  • The Americans with Disabilities Act
  • Federal Civil Rights Act
  • The Age Discrimination in Employment Act

Employment discrimination cases often arise as a result of:

  • Hiring practices
  • Reasons for termination
  • Reasons for not considering someone for a promotion
  • Reasons for demoting someone

In general, if the decisions above are based on a person’s race, national origin, age, sex, gender, sexual orientation, disability, or religion, then unlawful discrimination may have occurred. We also handle employment claims related to sexual harassment, hostile work environments, slurs, and other issues.

When evaluating a workplace discrimination case, questions to ask may include:

  • Did unfair treatment occur, and was it based on a person’s race, skin color, sexual orientation, origin, age, disability, genetic information, gender identity, or pregnancy?
  • Did managers, colleagues, or other people in the workplace harass an employee, and was the harassment aimed at the individual’s race, skin color, sexual orientation, origin, age, disability, genetic information, gender identity, or pregnancy?
  • Was a reasonable accommodation denied to an individual, and did that individual need the accommodation because of their religion or a disability?
  • Did the employee receive inappropriate questions about their health, medical condition, or genetic information?
  • Was the employee retaliated against after submitting a discrimination complaint?

Questions like these are a standard way of determining what took place and if an employee or employer is in the wrong.

If you are searching for an experienced employment discrimination attorney, either to defend your business or to handle your discrimination claim against an employer, please call our law firm in New York, at 518-792-1174, or in Florida, at 305-751-8556. At McPhillips, Fitzgerald & Cullum, our legal team is ready to stand at your side and obtain the best possible results on your behalf.
