Recently, DeWALT issued a recall for more than 1.4 million of its 12-inch Sliding Compound Miter Saws. According to the recall issued by the company, the saw’s rear safety guard, designed to prevent laceration and amputation, can break or detach. This poses a serious risk to operators and bystanders who may be hit by projectiles when the guard detaches.

Unfortunately, instances like this are far from rare. Thousands of products are recalled yearly due to design flaws, poor manufacturing practices, cheap parts, and sloppy assembly. Victims are entitled to seek fair compensation through legal action when one of these products causes harm, even if it has been recalled.

Does a Recall Protect a Company from Legal Consequences?

Recalls are intended as a stop-gap to prevent injury and avoid legal ramifications from a defective or dangerous product. However, a recall is not a protection against liability. When a company has produced a dangerous or defective product, it can be held liable for any damages that result from its negligence.

When you are the victim of a  defective product , you might be faced with expenses from medical care, home modifications, and assistive technologies. You may be unable to work or faced with new, permanent limitations, all while suffering from the pain and anguish that can accompany a severe injury. These things demand justice.

If you are injured or a defective product kills a loved one, you need a lawyer on your side who can help you understand your options. Product liability claims are often complex. Working with a law firm that knows how to handle these cases is essential. So too is choosing one that will stand by your side and fight for the best possible outcome, no matter what the other side brings.
